DuraMax BP is an authorized dealer of DuraMax brand products manufactured by US Polymers-Accuform. All products sold on the Site are sourced directly from the manufacturer and are covered by the manufacturer's standard warranty registered in the purchaser's name.

3.5 Orders and Acceptance

Submitting an order constitutes an offer to purchase. Your order is accepted when we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, payment issues, product availability, pricing errors, or geographic restrictions.

3.6 Payment

Payment is due in full at the time of order, except where financing is selected (Shop Pay Installments, Affirm, etc.). Financing is provided by third-party lenders subject to their own terms; DuraMax BP is not a lender and does not extend credit directly.

We accept Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, Shop Pay, and Affirm. Sales tax is calculated at checkout based on your delivery address.

3.7 Shipping and Delivery

Shipping terms, freight handling, lift-gate service, accessibility responsibilities, and damage inspection requirements are governed by our Shipping Policy, which is incorporated by reference into these Terms.

Risk of loss for products transfers to the customer upon the carrier's tender of delivery to the destination address.

3.8 Cancellations, Returns, and Refunds

EXCEPT FOR THE MANUFACTURER'S WARRANTIES EXPRESSLY PROVIDED, ALL PRODUCTS ARE SOLD "AS IS" AND DURAMAX BP DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

3.10 Permits, HOA Rules, and Local Regulations

It is the customer's responsibility to confirm any applicable building permit, HOA approval, or local zoning rule before ordering. DuraMax BP is not liable for inability to install a product due to denied permits, HOA restrictions, or other local regulations. Such situations are subject to our standard Return Policy.

3.11 Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of [Legal Entity Name] or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws. TO THE FULLEST EXTENT PERMITTED BY LAW, DURAMAX BP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT PURCHASED, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
